Service Terms (General)


Relationship to Other Service Agreements


These Service Terms (General) apply to all services provided by PCTECH Computer Services Inc., whether services are provided onsite, remotely, at depot, on a one time basis, or as part of ongoing managed services. These terms apply in addition to the Website Terms of Use and Privacy Policy.


Certain services may also be subject to additional service specific terms or disclaimers depending on the type of service being performed, including Break and Fix Service Disclaimers and services provided under a Managed Services Agreement. Where multiple agreements or disclaimers apply to the same service, all applicable terms remain in effect and are intended to be read together unless expressly stated otherwise in writing.



Services provided under a Managed Services Agreement are governed by the scope, limitations, and obligations stated in that agreement and any written service summary, quote, or schedule. Break and Fix services are generally provided on a one time, time and materials, or per job basis and do not include ongoing monitoring, maintenance, security management, backup management, or response commitments unless explicitly agreed to in writing. A Managed Services Agreement may reduce risk through proactive services, but it does not eliminate the risk of downtime, hardware failure, security incidents, or data loss. Clients remain responsible for business continuity planning, regulatory compliance, insurance coverage, and data retention obligations unless otherwise stated in writing.

Limitation of Liability


To the maximum extent permitted by law, PCTECH Computer Services Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of business, loss of revenue, loss of profits, business interruption, loss of use of systems or equipment, loss of contracts or customers, or the cost of substitute equipment or services, even if PCTECH Computer Services Inc. has been advised of the possibility of such damages.

The total cumulative liability of PCTECH Computer Services Inc. for any claim arising out of or related to any service shall not exceed the amount paid by the client for the specific service giving rise to the claim.

For clients covered under a Managed Services Agreement, liability limits shall be further governed by the terms of that agreement.

PCTECH Computer Services Inc. shall not be responsible for failures, delays, or damages resulting from causes beyond its reasonable control, including power outages, internet failures, cloud provider outages, manufacturer defects, cyber incidents, or natural disasters.

Nothing in these terms limits liability where such limitation is prohibited by applicable law.



Payments and Billing


Payment is due upon completion of service unless otherwise agreed to in writing.

Deposits may be required prior to ordering parts, performing extended diagnostics, or initiating third-party services.

Deposits are non-refundable once parts are ordered or external services are initiated.

Unpaid invoices may result in suspension of service or withholding of equipment until payment is received.



Unclaimed and Abandoned Equipment

Devices not collected within thirty days of service completion or notification may be considered abandoned.

PCTECH Computer Services Inc. is not responsible for loss, damage, or data on abandoned equipment.

Storage fees may be charged for uncollected equipment.

Abandoned equipment may be recycled, resold, or disposed of to recover unpaid balances or storage costs where permitted by law.

Clients are responsible for maintaining accurate and current contact information.



Intake, Inventory, and Custody of Property


Only items physically presented and documented at intake are considered accepted into custody.

PCTECH Computer Services Inc. is not responsible for accessories, components, or media not provided or documented at intake.

Claims regarding missing items must be reported immediately upon pickup of equipment.

Claims made after equipment has left the premises may not be verifiable.



Premises and Personal Safety


Clients entering PCTECH Computer Services Inc. premises do so at their own risk and are responsible for exercising reasonable care for their personal safety.

PCTECH Computer Services Inc. is not responsible for injuries not caused by proven negligence of staff.

Clients must follow posted instructions and verbal directions while on the premises.



Video Surveillance


PCTECH Computer Services Inc. premises are monitored by continuous video surveillance for security, safety, and loss prevention purposes.

By entering the premises, clients acknowledge and consent to video recording in public and service areas.

Video recordings may be used to verify intake, handling of equipment, disputed events, and security incidents.

Surveillance footage is not guaranteed to be retained indefinitely.



Right to Refuse or Terminate Service


PCTECH Computer Services Inc. reserves the right to refuse, suspend, or terminate service at its sole discretion.

This includes situations involving abusive language, threatening behavior, harassment, unreasonable demands, refusal to comply with staff instructions, unsafe equipment, or suspected unlawful activity.

Refusal of service does not obligate PCTECH Computer Services Inc. to continue diagnostics or repair beyond reasonable return of property.



Third Party Products and Services


PCTECH Computer Services Inc. may recommend or configure third-party products or services, including hardware, software, cloud platforms, and data recovery providers.

PCTECH Computer Services Inc. is not responsible for the performance, availability, security, pricing, or policies of third-party providers.

Any warranties or guarantees are provided solely by the manufacturer or service provider.



Governing Law and Jurisdiction


These Service Terms (General) are governed by the laws of the Province of British Columbia and the laws of Canada applicable therein.

Any disputes shall be subject to the exclusive jurisdiction of the courts of British Columbia.



Entire Agreement


These Service Terms (General), together with the Privacy Policy, Website Terms of Use, applicable Break and Fix disclaimers, and any Managed Services Agreement, constitute the entire agreement governing services provided by PCTECH Computer Services Inc.

In the event of conflict, the terms of a signed Managed Services Agreement shall prevail for services covered by that agreement.
